Terms of use

These terms set the conditions of using FaultCrate (the "Service"), provided by Off-Nadir Lab (the "Operator"). Anyone who uses the Service (a "User") is taken to have agreed to them. The Japanese text governs.

1. What the Service is

The Service gathers records of vehicle faults, repairs and recalls published by public bodies, manufacturers and others, arranges them so that they can be found by vehicle and symptom, and shows them with their original text and source.

The Service goes as far as collecting, selecting, arranging and comparing the records and following how they move. Judging the cause of a fault and deciding how to service a vehicle are for the User. The Service does not diagnose a vehicle, instruct a repair, or guarantee the result of any work.

2. States of use and prices

The Service has four states of use: unregistered, registered (free), registered plus added vehicles, and all vehicles. What each covers and costs is shown on the Plans page and in the notice under the Act on Specified Commercial Transactions.

A paid plan is a monthly contract that renews automatically until it is cancelled. The price is charged at each renewal to the payment method the User registered.

A change of price is announced on the Service or to the registered email address at least 30 days before it takes effect.

3. Cancellation and refunds

A User may cancel a paid plan at any time. After cancelling, the scope of the plan stays usable until the end of the period already paid for.

Amounts already paid are not refunded. Where the Service could not be provided for a long time, or a charge was made twice or in error, the Operator may make a refund after looking into the case. Where the law requires a refund, the law is followed.

4. Accounts

A User who registers gives correct information and keeps their sign-in details themselves. An account may not be lent or transferred to a third party.

The "registered plus added vehicles" and "all vehicles" contracts are for the work of the User who made them (for a service or sales shop, that shop).

5. What is prohibited

Taking the contents of the Service in bulk by automated means.

Copying what the Service has arranged (summaries of documents, write-ups of known issues, Japanese translations, classifications) to provide or sell it to third parties. Quoting or printing single records in the course of one's work is not prevented.

Unauthorised access, acts that interfere with the running of the Service, and acts against the law.

6. The nature of the information and the limits of responsibility

The records the Service shows are what their sources published. The Operator does not guarantee that they are accurate, complete or current. The nature of each source, and what to be careful of, is described on the Sources page.

A count of records is the number reported. It is not a failure rate, and not the probability of a cause.

The Japanese translations, and the causes and remedies read out of the records, include machine processing. Check them against the original text and the source shown with them before relying on them.

The Operator is not responsible for the results of inspection, service, sale or other acts done on the basis of the Service, except where they arise from the Operator's intent or gross negligence. Where the Operator is responsible, the amount is limited to what the User paid for the Service in the preceding 12 months, except where the Consumer Contract Act or other law does not allow this limit.

7. Rights

The rights in the sources' documents and records belong to their respective holders. The rights in the arrangement, summaries, translations and screens made by the Service belong to the Operator.

GMC, Yukon and other vehicle names and trademarks belong to their respective holders. The Service is not affiliated with or endorsed by any manufacturer or source body.

8. Changes, interruption and end of the Service

The Operator may change the contents of the Service and may suspend it temporarily for maintenance or because of a failure.

If the Service is to end, this is announced at least 30 days before. For a paid plan with a paid period remaining at the end, the price for the remaining period is refunded.

9. Suspension of use

If a User acts against these terms, the Operator may suspend that User's use or end the contract.

10. Changes to these terms

The Operator may change these terms when necessary. The change and the day it takes effect are announced on the Service beforehand.

11. Governing law and court

These terms are governed by the law of Japan. The Tokyo District Court is the exclusive court of first instance for disputes about the Service.
